Pennsylvania Democrat Philip J. Berg, who filed a lawsuit demanding Sen. Barack Obama
present proof of his American citizenship, now says that by failing to respond Obama
has legally “admitted” to the lawsuit’s accusations, including the charge that the Democratic candidate was born in Mombosa, Kenya.

As WND reported, Berg filed suit in U.S. District Court in August, alleging Obama is not a natural-born citizen and is thus ineligible to serve as president of the United States. Though Obama has posted an image of a Hawaii birth certificate online, Berg demands that the court verify the original document, which the Obama campaign has not provided.
Now Berg cites Rule 36 of the Federal Rules of Civil Procedure, which states that unless the accused party provides written answer or objection to charges within 30 days, the accused legally admits the matter.
Since Obama has only filed motions to dismiss and has not actually answered the charges in the lawsuit, Berg claims, according to Rule 36, Obama has legally admitted he is not a natural-born citizen.

You are missing the point, Joe. He is a public servant and must provide this info for his job application. He has now been subpoened for the birth certificate and could end the issue by simply releasing the certificate as he is required. This behavior is odd at best and an admission that he does not have a certificate showing he was born in Hawaii.
Attacking those that are expecting Obama to follow the constitution shows a dangerous loyalty to the candidate and not the country. Ask your candidate to end this issue by providing the required documentation.
It is in his own best interest.

I had to show my kids birth certificate to get him into *Little League* for gosh sake..and kindergarten and college..and his passport..and why has Obama hidden his?? and How is that legal..to run for POTUS without showing his????????
Do remember it was *Obama’s people* who breached the passport of himself and Hillary and McCain..and it was Obama who blamed Hillary for it..until it was proved it was Obama’s own people who illegally breached the passport records of the others..but he deflected by blaming the others for what his own people did! Joe, Obama’s Proof of Birth looks pretty phoney to most people. No official seal and no signature. Also, his dad’s mom said he was born in Kenya. Could be that Obama was told he was born in Hawaii by his mom, Stanley Soetero.
I wonder how long he can legally drag this out in hopes that no decision is made (and then there’s appeals).
I also would like to know if he does win as he is dragging this out with non-compliance, if he then can be impeached. Have to remember our last presidential impeachment - getting pretty darn embarrasing in front of the rest of the world, don’t you think?
This is federal court and I can read rule 36 without a problem but it’s not clear whether he has complied with an answer with a motion to stop the discovery. I’m a paralegal - I want to hear from a qualified attorney who has been in federal court please. And donating money to the suit should be easier!
How on earth has Obama been let of the hook for any of the things he has done. If he is not a American born citizen why is he not exposed before the election?
